General terms and conditions (T&C)

1.             Fast Swing Weekend festival (festival) is organised by MTÜ Tallinn Swing Dance Society and MTÜ Tallinn Swing Events (organisers).

2.             By paying the participation fee (fee) the participant confirms that he/she has read and accepted the general terms and conditions (contract or T&C). The contract enters into force upon payment of the fee.

3.             Only natural persons of legal age (18 years; the participant) can take part of the festival. The organisers will not check the age of the participants and the payment of the fee confirms that the registered participant is an adult and that the information provided is true. 

The purchase of the festival pass (the pass)

4.             The participant can buy the pass via the Tallinn Swing Dance Society website: https://www.tsds.ee/fast-swing-wekend23-en/. The purchased pass will be assigned to the individual participant. The participant can modify information by sending an email to info@tsds.ee.  

5.             The pricelist of the passes are available on the festival’s website https://www.tsds.ee/passes-prices/ or its subpage. The organisers reserve the right to make changes to the price list by informing participants via the festival website.

6.             After registration, confirmation of receipt of registration and instructions on how to pay the registration fee will be sent to the participant’s e-mail address. It is the responsibility of the participant to provide the organisers with the correct email address.

7.             In the event that someone registers and/or pays on behalf of someone else (e.g. as a gift), the organisers will assume that the participant is the one whose contact details are provided via the registration form. In this case, the person completing the registration form must ensure that the actual participant reads and agrees to T&C. In the event of a refund of the fee, the fee will be returned to the bank account from which the transfer was made.

8.             Based on the information given on the registration form, the organisers will divide participant into level groups. The organisers and the festival teachers reserve the right to change the participant’s group during the festival if they deem it necessary. If the organisers or the festival supervisors so wish, they may also organise an audition for the purpose of group allocation. 

Participation

9.             The organisers aim to ensure a balance of leaders and followers in the hours of the festival, but it is not mandatory.

10.         Participants must respect basic rules of courtesy. For example, but not limited to:

10.1.                    during the classes, the mobile phone must be kept in silent mode;

10.2.                    clean indoor footwear is compulsory indoors.

11.         At the beginning of the festival, participants are given a wristband that refers to their dance class. Wearing this wristband during the festival is compulsory and will guarantee access to the festival classes and/or the party, as appropriate.

12.         Recording of class material (photography, filming etc.) is only allowed with the permission of the organisers of the festival teachers. Videos summarising the lessons, in which the festival teachers demonstrate the content of the class (recap video), may only be used for personal purposes and may not be distributed. The restriction of recording does not apply to parties.

13.         By paying the fee, the participant agrees to and grants the organiser the right to take pictures, film and use the recorded material for publicity purposes.

14.         Any participant who feels physically unwell, or is suffering from any symptoms of illness, or has been assigned to isolation, must inform the festival organisers and not participate at the festival. 

Liability

15.         The organisers are not liable for loss or damage of the participant’s valuables.

16.         The organisers will not be liable for any injury to the participant. It is the participant’s responsibility to be attentive to themselves and others.

17.         All verbal, physical and mental harassment, as well as unwanted (sexual) attention and inappropriate physical contact with others, or other disruptive unethical behaviour, is  prohibited. The organisers reserve the right to issue a warning and/or immediately cancel the participant’s pass to the festival in response to such behaviour and to order the person to leave immediately. In this case, the participant will not be refunded the participation fee or the party ticket.

18.         The participant has the obligation to inform the organisers immediately of any inappropriate or unethical behaviour. 

Withdrawal and cancellation

19.         The pass purchase is final and non-refundable.

20.         If participant receives a positive covid-19 test result before the festival and cannot attend the festival due to isolation, he/she must submit his/her pcr test result to the organisers. The organisers will then refund 75% of the participation fee.

21.         If the festival is cancelled due to an event of force majeure, the participant will be refunded 75% of the fee.

22.         An event of force majeure is any circumstance beyond the reasonable control of the organiser or the participant which could not reasonably have been contemplated at the time of the conclusion of the contract and the consequences of which they could not reasonably have avoided or overcome. Including, but not limited to, the following shall be deemed by the organisers and the participant to be such circumstances: accident, explosion, fire, storm, earthquake, flood, drought, natural disaster, strike, industrial action, pandemic, emergency, industrial dispute, riot, sabotage, act of terrorism, civil war, revolution, war and any impediment arising from any governmental or other public authority’s order, law, regulation, rule, order or other legislative enactment.

23.         If the festival is cancelled for reasons attributable to the organisers (personal reasons except force majeure), the participant will be refunded 100% of the fee.

24.         In case the organisers are obliged to require the participant to have a vaccination certificate due to the obligation established in the Republic of Estonia, the organisers will not refund the fee to the participant if the participant does not have a vaccination certificate.

25.         The participant is entitled to resell his/her pass only with the permission of the organisers and only to a dancer of the same level and performing the same role (leader/follower). A participant may sell a ticket to a dancer of a different level or in a different role only with the consent of the organisers. When selling a pass, the participant must provide the organisers with the new participant’s contact details (the same details as requested on the registration form) and inform the new participant of the T&C.

26.         Resale of the pass donated by the organisers or given free of charge is prohibited. The pass is valid for the participant to whom it has been given as a gift or free of charge by the organisers.

27.         The organisers reserve the right to cancel passes fraudulently obtained or resold without authorisation without refund. 

Data processing

28.         The organisers collect and process data, including personal data, related to the registration of the participant.

29.         The controller of the personal data is MTÜ Tallinn Swing Dance Society, The authorised processor of the personal data is MTÜ Tallinn Swing Events and other persons performing tasks related to the organisation of the festival. The controller confirms that the processors are authorised to process the data to the minimum extent possible.

30.         The organisers collect data for the running of the festival, planning of classes and parties, accounting requirements, marketing, communications, other essential information and statistics.

31.         Personal data will be kept for as long as necessary for the fulfilment of the purpose for which they were collected, for legal reasons or for the protection of the rights of the organisers, but not longer than 10 years. For example, accounting data will be kept for 7 years from the end of financial year.

32.         Organisers will take the necessary measures to ensure the security and preservation of the participants’ data.

33.         The participant has the right to withdraw his/her consent to data processing. Withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent prior to the withdrawal. Consent can be withdrawn by sending an email to info@tsds.ee. Irrespective of the withdrawal of consent, the organisers are entitled to process the data for the purposes of organising the festival and for the fulfilment of their reporting obligations.

34.         The participant accepts that in connection with the organisation of the festival some services may be provided by third parties and that the organisers may have connections to third party service providers’ software or systems (e.g. website administrator). The organisers shall not be liable in any way for the activities of such third parties or for any part of the interfaces or integration tools supplied, maintained or owned by third parties.

37.         The organisers may make changes to the festival programme, schedule, list of teachers, band and other changes without informing the participants.

38.         This contract shall be governed by the law of the Republic of Estonia. The parties shall attempt to settle the dispute by negotiation, but in the event of their failure the dispute shall be settled by Harju County Court.

39.         The T&C are drafted both in Estonian and in English. In case of dispute, the Estonian text will prevail.
